"Probate" matters, such as the administration of an estate or trust, guardianships, and the actions of an individual who has been appointed as a Durable Power of Attorney, can lead to disputes. These disputes can arise from interpersonal conflict, inadvertence or improper conduct. Other times, there may be a dispute over whether a Will or trust is valid, and whether the person who made it was incapacitated or subject to undue influence. Still other times, the conflict may come from a question as to the meaning of a term of a Will or trust, or a question as to how and estate or trust should be administered. Whatever the basis, our philosophy is to work with our clients to solve the conflict. When possible, we try to help our clients resolve the conflict through constructive discussions and negotiation. When necessary, however, we are prepared to help our clients solve the conflict through the processes of litigation.
